Welcome to Cinema iHub (“Cinema iHub,” “we,” “our,” or “us”). These Terms of Use (“Terms”) form a binding agreement between you and Scenenix Media Broadcasting Private Limited governing your access to and use of our website, applications, tools, application programming interfaces, and related services (collectively, the “Platform”). By accessing or using the Platform, you accept these Terms. If you do not agree, you must not use the Platform. Our Privacy Policy and Refund Policy are separate documents and are expressly excluded from this consolidation.

1. Eligibility and Authority

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are accessing the Platform on behalf of an entity, you represent and warrant that you are duly authorized to bind that entity and that all references to “you” encompass both you and the entity you represent.

2. Account Registration and Communications

Certain features require registration. You agree to provide accurate and current information and to keep that information updated. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. If you suspect unauthorized access, you must promptly notify us at support@cinemaihub.com. By registering, you consent to receive essential service, transactional, and security communications related to your account. Marketing communications, if any, will follow applicable consent and opt-out requirements.

3. License, Access, and Ownership

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for your lawful purposes. The Platform, including its software, models, interfaces, visual design, and trademarks, is owned by Scenenix Media Broadcasting Private Limited or its licensors and protected by intellectual property laws. Except for rights expressly granted, no rights are conferred by implication or otherwise, and all rights not expressly granted are reserved.

4. Acceptable Use Policy

You agree to use the Platform only in compliance with law and these Terms. You must not engage in actions that are illegal, defamatory, obscene, exploitative, invasive of privacy, hateful, or otherwise harmful. You must not infringe or misappropriate intellectual property, publicity, or privacy rights. You must not interfere with, probe, scan, or test the vulnerability of any system or network; circumvent or violate any security or authentication measures; disrupt or overburden the Platform; or attempt to access data not intended for you. Automated scraping, undisclosed data harvesting, malware generation or distribution, child sexual abuse material, non-consensual intimate imagery, and content that promotes violence or self-harm are strictly prohibited. You must comply with applicable sanctions, export controls, and platform rate limits.

5. AI Responsible Use and Synthetic Media Disclosure

The Platform may generate or transform media based on prompts and inputs you provide. You are solely responsible for your prompts, inputs, and outputs, including verifying accuracy, suitability, and compliance before publication. You must not use outputs to impersonate individuals, to fabricate endorsements, or to mislead audiences about the nature or source of content. Where law or platform policy requires disclosure that media is synthetic or materially manipulated, you agree to provide clear and conspicuous disclosure and to obtain any required consents for the use of names, likenesses, voices, or other protected attributes. You must not use the Platform for medical, legal, or financial advice generation in a way that purports to replace licensed professionals or that could reasonably cause harm.

6. User Content and Intellectual Property

You retain ownership of content you submit to the Platform (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display User Content solely to operate, maintain, secure, and improve the Platform, provide support, comply with law, and prevent abuse. You represent and warrant that you have all necessary rights in User Content and that our use in accordance with these Terms will not infringe any third-party rights. Feedback or suggestions you provide may be used by us without restriction or obligation.

7. Copyright Complaints and Notice-and-Takedown

If you believe content on the Platform infringes your rights, you may submit a detailed notice identifying the work claimed to be infringed, the allegedly infringing material, your contact details, and a statement of good-faith belief and accuracy. Upon receipt of a valid notice, we may remove or disable access to the content, notify the user, and request further information. If you believe content was removed in error, you may submit a counter-notice with sufficient detail for review. We may restore content in our discretion where appropriate under applicable law. Misuse of notice procedures may result in account actions.

8. Community Conduct and Moderation

If the Platform allows sharing, showcasing, or comments, you must engage respectfully and comply with these Terms. We may moderate, remove, or restrict content or accounts that violate these Terms or applicable law, or that pose safety, security, or reputational risks. Repeat or egregious violations may result in suspension or termination.

9. Cookies and Tracking Technologies

We use cookies, local storage, and similar technologies to authenticate sessions, remember preferences, measure usage, and improve performance and safety. You can manage certain preferences via your browser and, where available, a cookies interface on the Platform. Some features may not function properly if you disable essential cookies. Details about personal data associated with cookies are addressed in our separate Privacy Policy.

10. Data Retention and Account Deletion

We retain account records, operational logs, safety signals, and technical telemetry for periods consistent with operating and securing the Platform, complying with legal obligations, resolving disputes, and enforcing our agreements. You may request account closure, after which we will delete or de-identify account-linked data subject to legal retention requirements, backup constraints, fraud prevention needs, and safety obligations. Removal of content previously shared publicly may not be fully achievable if third parties have copied or rehosted such content.

11. Security and Vulnerability Disclosure

We implement administrative, technical, and physical safeguards designed to protect the Platform. No system is entirely secure, and you are responsible for safeguarding your credentials and devices. Security researchers may report vulnerabilities responsibly to support@cinemaihub.com with sufficient detail to reproduce findings. In good faith, you should avoid accessing user data, disrupting service, or degrading performance during testing, and you should allow reasonable time for remediation before public disclosure.

12. Third-Party Services and Subprocessors

The Platform may interoperate with third-party services such as hosting, analytics, payment processing, model providers, or content delivery networks. Your use of third-party services may be subject to their separate terms. We may change service providers and subprocessors over time to operate and improve the Platform. We are not responsible for third-party acts or omissions, and availability of integrations may vary by region or plan.

13. API Terms and Rate Limits

If you access any Cinema iHub application programming interface, software development kit, webhook, or similar developer functionality, you agree to use valid keys, to keep credentials confidential, to respect documented rate limits, and to avoid activities that degrade or bypass platform controls. You may not resell, sub-license, or expose the APIs in a manner that permits unauthenticated use, and you must implement reasonable safeguards against abuse. We may modify or discontinue APIs, impose quotas, or revoke access to protect the Platform or comply with law.

14. Branding, Attribution, and Publicity

You must not use our names, logos, or trademarks except as expressly permitted in writing. You must not imply endorsement, partnership, or certification without prior consent. Where attribution is required by feature-level documentation, you agree to display accurate attribution. Any publicity, press releases, or case studies referring to Cinema iHub require prior written approval unless otherwise agreed.

15. Promotions, Trials, and Credits

Promotional offers, trials, and credits may be issued at our discretion, may be subject to eligibility limits, and may expire. Such benefits have no cash value, are non-transferable, and may be revoked in cases of abuse such as creating multiple accounts to obtain repeated benefits. Terms specific to a promotion will govern in the event of a conflict with this section.

16. Communications and Anti-Spam

You agree not to use the Platform to send unsolicited or deceptive communications. Where we provide messaging features, you must obtain any necessary consent from recipients and include required disclosures. We may rate limit or restrict messaging features to prevent spam, fraud, or abuse. You may manage marketing preferences in accordance with applicable law while continuing to receive essential service and security notices.

17. Open-Source and Third-Party Licenses

The Platform may incorporate open-source software or third-party components whose licenses may grant you additional rights or impose obligations. To the extent required, those licenses govern your use of such components and are incorporated by reference. In the event of a direct conflict between a required open-source license term and these Terms, the open-source license will control for the affected component.

18. Export Controls and Sanctions

You represent that you are not subject to any embargo, sanction, or restricted party designation and that you will not use the Platform in embargoed territories or for prohibited end uses. You agree to comply with applicable export control and sanctions laws, including restrictions on the transfer of certain technologies and data.

19. Service Changes, Availability, and Suspension

We may change, suspend, or discontinue any feature or component of the Platform to improve functionality, enhance security, comply with law, or address operational needs. We may suspend or terminate access where we reasonably believe you have violated these Terms, pose a security or legal risk, have failed to pay amounts due, or where required by law. Upon termination, your right to use the Platform ceases, but provisions that by their nature should survive will continue to apply.

20. Disclaimers

The Platform and all outputs, content, and features are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that defects will be corrected. You acknowledge that AI systems may produce unexpected, biased, or unsuitable results and that you assume all risk for your use of outputs.

21. Limitation of Liability

To the fullest extent permitted by law, Cinema iHub, Scenenix Media Broadcasting Private Limited, and their affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or other intangible losses arising out of or related to your use of or inability to use the Platform, even if advised of the possibility of such damages. Our aggregate liability for all claims will not exceed the greater of the amounts you paid to us for the service during the three months preceding the event giving rise to the claim or INR 10,000.

22. Indemnification

You agree to defend, indemnify, and hold harmless Cinema iHub and its affiliates and personnel from and against all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to your use of the Platform, your User Content, your prompts or outputs, your violation of these Terms, or your violation of any rights of another person or entity.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of India without regard to conflict-of-laws principles. The courts located in Hyderabad, Telangana shall have exclusive jurisdiction over disputes arising out of or related to these Terms or the Platform, except that we may seek injunctive or equitable relief in any jurisdiction to protect our intellectual property, confidential information, safety, or security interests.

24. Updates to These Terms

We may revise these Terms to reflect changes in our services, technology, or legal requirements. When we make material changes, we will update the effective date above and, where required, provide additional notice. Your continued use of the Platform after the effective date signifies your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform.
